Terms of Service
These terms govern your use of TimeNova, the time tracking and workforce analytics service at timenova.ai and app.timenova.ai. By creating an account or using the service you agree to them. "We" and "us" means TimeNova; "you" means the company or person holding the account.
1. The service
TimeNova tracks working time, application and website usage, and, where enabled, periodic screenshots or screen recordings, and presents them in reports. Two tracking surfaces exist: a desktop app that each person starts and stops themselves, and a silent agent a company installs on machines it manages. Features vary by plan as described on the pricing page.
2. Accounts
You must provide accurate information when creating an account and keep your sign-in credentials secure. You are responsible for what happens under your account. Each account has exactly one owner; ownership can be transferred to an admin from inside the product.
3. Your responsibilities as an employer
TimeNova is a monitoring tool, and the laws on workplace monitoring differ by country and state. As the customer, you are responsible for:
- Having a lawful basis for tracking the people you track, and providing any notice or obtaining any consent your jurisdiction requires.
- Only installing the silent agent on machines you have the authority to manage.
- Using the data the service produces in accordance with your local employment law.
We build the product consent-first (everyone using the desktop app sees their own data, and we encourage self-view for silently tracked people), but the legal duty to track lawfully is yours. If you need a data processing agreement, request one at support@timenova.ai.
4. Acceptable use
You may not use TimeNova to track people you have no employment or contractual relationship with, attempt to access another account's data, probe or disrupt the service, resell the service without an agreement with us, or use it for anything unlawful. We may suspend accounts that do.
5. Trial, billing and cancellation
- New accounts get a 14-day free trial with every feature included. No card is required to start. One free trial per email address per year.
- Paid plans are priced per user per month, billed monthly or annually, as shown on the pricing page. A user is every person on the account roster.
- Payments are processed by our merchant of record, which is the seller of record for the transaction and handles applicable taxes and invoices.
- You can cancel at any time. Cancelling stops future renewal; your data is not erased by cancelling. Refunds are covered by the refund policy.
- If a trial ends without a subscription, the account's data is erased 30 days later, with an email warning 7 days before.
6. Your data
The data your account collects belongs to you. We process it to provide the service, as described in the privacy policy, and for nothing else. We do not sell it, share it with advertisers, or train AI models on it. On deletion of a person or an account, the underlying data including stored media files is erased.
7. Availability and changes
We aim to keep the service available at all times but do not guarantee uninterrupted operation. We may improve or change features; if a change materially reduces what your plan includes, we will tell you in advance. Trackers update themselves so that fixes reach installed machines.
8. Disclaimer and limitation of liability
The service is provided as is. To the maximum extent permitted by law, we disclaim implied warranties, and our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential losses, or for decisions you make based on the reports. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Termination
You can delete your account at any time. We may suspend or terminate an account for material breach of these terms, and where practical we will warn you first. Sections that by their nature should survive termination (data ownership, liability limits, governing law) survive.
10. Governing law
These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts there, unless mandatory law in your country provides otherwise.
11. Changes to these terms
If we change these terms in a way that matters, we will email account owners before the change takes effect. The date at the top always tells you when they last changed.
